By accessing our website, requesting a quote, placing an order, or purchasing any product or service from us, you agree to be bound by these Terms. 1. Acceptance of Terms
By using this website or purchasing from us, you represent that you are at least 18 years of age and legally capable of entering into a binding contract. These Terms, together with any invoice, sales order, financing agreement, or other document you sign, constitute the entire agreement between you and Barrett Auto Gallery with respect to your purchase. If any signed document conflicts with these Terms, the signed document controls for that transaction.
2. Products and Services
Barrett Auto Gallery sells new and pre-owned golf carts and low-speed vehicles, along with parts, accessories, service, repairs, and (through third parties) financing and delivery. Specifications, features, colors, and availability are subject to change without notice. We reserve the right to limit quantities, discontinue products, and refuse or cancel any order at our discretion.
3. Quotes, Orders, and Order Acceptance
Quotes are estimates and are not binding until confirmed in writing by Barrett Auto Gallery. Your submission of an order is an offer to purchase; no order is accepted until we confirm it in writing and, where applicable, receive your deposit or payment. We may decline or cancel any order, including for pricing errors, unavailability, suspected fraud, or other reasons, in which case any amounts paid for the cancelled order will be refunded.
4. Pricing, Fees, and Taxes
All prices are in U.S. dollars and are subject to change without notice. Unless expressly stated, prices do not include applicable taxes, title, registration, documentation or dealer fees, delivery charges, accessories, or optional add-ons. You are responsible for all sales and use taxes and government fees associated with your purchase. In the event of an obvious pricing or typographical error, we reserve the right to cancel the affected order even after it has been confirmed.
5. Payment, Deposits, and Down Payments
Payment is due as stated on your invoice or sales order. We may require a non-refundable deposit or down payment to reserve or order a vehicle. Unless otherwise stated in writing, deposits applied to custom orders, special orders, or ordered inventory are non-refundable. Title to any product remains with Barrett Auto Gallery until payment is received in full. Returned or failed payments may incur additional fees to the extent permitted by law.
6. Financing
Financing, when offered, is provided by independent third-party lenders, not by Barrett Auto Gallery. Approval, rates, terms, and conditions are determined solely by the lender and are subject to credit approval. We do not guarantee financing approval or any particular rate or term, and we are not responsible for the acts, omissions, or decisions of any lender. Any financing agreement is solely between you and the lender.
7. Delivery, Pickup, and Risk of Loss
Delivery dates and time windows are estimates only and are not guaranteed. We are not liable for delays caused by events beyond our reasonable control. Unless otherwise agreed in writing, risk of loss passes to you upon delivery or upon your (or your agent’s) taking possession at pickup. You are responsible for ensuring safe and lawful access to the delivery location.
8. Inspection and Acceptance
You are responsible for inspecting each product at the time of delivery or pickup. By accepting the product, you confirm that it conforms to your order except for any defects noted in writing at that time. Claims for visible damage, shortage, or non-conformity must be made at delivery or pickup.
9. Cancellations, Returns, and Refunds
Except where required by law or expressly stated in writing, all sales are final. Custom, special-order, ordered, used, and clearance items are non-returnable and non-refundable. Any approved return may be subject to a restocking fee and must be in new, unused, resalable condition with all original components. Refunds, when issued, are made to the original method of payment.
10. Warranties and Disclaimer of Warranties
New products may be covered by the applicable manufacturer’s limited warranty, which is provided by the manufacturer and not by Barrett Auto Gallery; we will pass through such warranty rights to you to the extent permitted. Unless a written warranty is expressly provided by Barrett Auto Gallery, all products — and all pre-owned products in particular — are sold “AS IS” and “WITH ALL FAULTS.” TO THE FULLEST EXTENT PERMITTED BY LAW, BARRETT AUTO GALLERY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. No statement by any salesperson creates a warranty.
11. Safe Operation, Lawful Use, and Assumption of Risk
Golf carts and low-speed vehicles can cause serious injury or death if misused. You are solely responsible for the safe, lawful, and proper operation, maintenance, and storage of any product you purchase, and for complying with all applicable federal, state, and local laws, including those governing registration, insurance, licensing, road and street use, equipment, occupancy limits, and operation by minors. You assume all risks associated with the ownership, operation, and use of any product purchased from Barrett Auto Gallery and agree that you, and not Barrett Auto Gallery, are responsible for the conduct of all operators and passengers. You agree to follow all manufacturer instructions and safety guidelines.
12. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, BARRETT AUTO GALLERY AND ITS OWNERS, MEMBERS, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR PERSONAL INJURY OR PROPERTY DAMAGE ARISING FROM OR RELATED TO YOUR USE OF OUR WEBSITE, PRODUCTS, OR SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR A TRANSACTION WILL NOT EXCEED THE AMOUNT YOU ACTUALLY PAID TO US FOR THE PRODUCT OR SERVICE GIVING RISE TO THE CLAIM. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
13. Indemnification
You agree to indemnify, defend, and hold harmless Barrett Auto Gallery and its owners, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your use or operation of any product, your violation of these Terms, or your violation of any law or the rights of any third party.

You agree to use our website only for lawful purposes. You may not interfere with the website’s operation, attempt to gain unauthorized access, scrape or harvest data, transmit malicious code, or use the site to infringe the rights of others. If this class-action waiver is found unenforceable, the remainder of this arbitration provision will likewise be unenforceable. To the extent any dispute proceeds in court, you agree to the venue described below.
21. Governing Law and Venue
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws principles. Subject to the arbitration provision above, you agree that the exclusive venue for any dispute will be the state or federal courts located in Palm Beach County, Texas, and you consent to personal jurisdiction there.
22. Force Majeure
We are not liable for any failure or delay in performance caused by events beyond our reasonable control, including acts of God, natural disasters, severe weather, labor disputes, supplier or manufacturer delays, shipping disruptions, government action, or utility or communications failures.
23. General
If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any provision is not a waiver of our right to do so later. You may not assign these Terms without our written consent; we may assign them freely. These Terms, together with your signed transaction documents and our Privacy Policy, are the entire agreement between you and Barrett Auto Gallery.

We may update these Terms from time to time. The updated version will be posted on this page with a revised Effective Date, and your continued use of our website or services after changes are posted constitutes acceptance of the revised Terms.
